Colorado Marijuana Laws

Federal surveillance planes, equipped with infrared cameras, have been used to track down marijuana growers in Colorado. These raids occurred in April of 2010 when possession of small amounts of pot have been legalized for nearly 10 years. Colorado became the fourth state to legalize medical marijuana in 2000 with Ballot Amendment 20. In November of 2005, the city of Denver legalized possession of up to an ounce.

Earlier this year (2011) Dr. Toribio Robert Mestas won his case, in Arapahoe County, after being arrested for writing loose medical marijuana recommendations and conspiring to distribute marijuana. This is a clear signal of more lenient social views on the once illegal plant. Many proponents are calling for the legalization of marijuana in 2012. This does not mean that dealing with marijuana is without consequences.

Although possession of marijuana (less than one ounce) is only a petty offense, the consequences for being convicted leave you ineligible for student loans or grants for college. Government workers and employees at many companies will loose their jobs with a pot related conviction. In addition, drug related charges including marijuana, could lead to the loss of the convicted’s drivers license. Colorado regulators are working with local law enforcement to track down the growing and sale of non-medical marijuana. Previously, law enforcement would leave growers alone who had less than 100 plants. This previous rule of thumb is in question as local officials begin to adopt new technology making it easier to track and investigate growing operations. A class four felony is punishable by two to five hundred thousand dollars in fines and two to eight years in prison. Serious charges require an aggressive defense.
